TERMS AND CONDITIONS

“we”, “us” or “our” means Demaga Logistics.
“you” or “your” means the sender, consignor or customer.
“consignee” means the person to whom the goods are consigned to.
“goods” or “shipment” mean the cargo transported under this consignment.

By handling over your shipment to us, you accept our terms and conditions as below:

  1. We will act as your agent, and as such you will authorise us to represent you to enter into any contracts necessary with the relevant parties.
  2. We will not accept dangerous goods and prohibited items including aerosol cans/sprays, explosives, firearms or weapons (swords, knives, chainsaws, etc), alcohol, car batteries, drugs, animal products like skins, furs and horn products (i.e. Ivory), easily damaged goods, currency exchange, bank notes, prohibited reading materials, goods which are prohibited under the law of both countries UK and Malaysia etc.
  3. You will only formally receive price list, invoice and receipt via email upon request.

Packing List

  1. You will provide us a full description of the contents of your consignment in the packing list. Your responsibilities and liabilities are not extinguished by providing this information.
  2. Packing list must be completed and returned to us via email by the time of goods collection.

Authority

  1. Your shipment may be subject to security screening and may be opened and the contents may be examined by the authorities during transit.
  2. We may be required to share your information, including your personal data given to us by you, with the authorities for customs and security reasons.
  3. If any customs authority requires additional information or documentation for the purpose of customs clearance, it is your responsibility to provide the required information or documentation at your expense.
  4. You acknowledge that all the statements and information you provide us are true and correct. In the event if you make untrue or fraudulent statements, you agree to indemnify us and hold us harmless from any claims that may be brought against us arising from the information you provide to us.
  5. Any customs duties, taxes, penalties, storage charges or other expenses we incur as a result of any form of actions by the customs and/or other governmental authorities including your failure to provide proper documentation will be charged to you.

Door to door handling processes

  1. We will do our best to expedite customs clearance but are not liable for any delays, losses or damage caused by interference from customs officers or other governmental authorities.
  2. You have prepared and packed safely and carefully the contents of the shipment to protect against the ordinary risks of transport and handling process. We are not liable for any delays, losses or damage arising from your failure of doing so.
  3. Upon delivery, the consignee shall check the condition of the goods. Once delivery form is signed, the goods will be deemed as delivered. If the consignee fails to take delivery at the agreed time and place, we are entitled to store the goods at our own choice of place for thirty days and are not liable for any losses or damage, after which the goods will be disposed of. RM 10 per package will be imposed for each day of storage within the said 30 days.  If second attempt of delivery is needed and arranged, the consignee will bear the expenses.
  4. Payment must be made as per agreed and if otherwise, we are entitled to store the goods at our choice of place for thirty days and are not liable for any losses or damage, after which the goods will be disposed of.  RM 10 per package will be imposed for each day of storage within the said 30 days.  For delivery, the consignee will bear the expenses.
  5. Once payment is agreed, and if there is any additional number of goods and/or weight, a new price will be quoted and the consignee will bear all the expenses.
  6. For door to door handling processes, a change of address in Malaysia may incur additional charges.
  7. For door to door handling processes, we reserve the rights to decide on the suitable vehicle for domestics collection and we will only collect and deliver the goods at the entrance of the building/residences.
